Preamble

Bohemian Beauty GmbH (hereinafter BB) acts as an intermediary, connecting clients (hereinafter Patient) with Czech specialist clinics and their physicians. BB is not a medical service provider and does not offer any medical services.

BB collaborates with a private plastic surgery clinic in Prague (Kartouzska 10, CZ-150 00 Prague 5). The specialist physicians for plastic surgery practising there include: MUDr. Jan Doman, MUDr. Pavel Jindra, MUDr. Michal Dufek, MUDr. Jaroslav Kulhánek, MUDr. Miroslav Sadlek, MUDr. Tomáš Fráňa, MUDr. Miroslav Macháček and MUDr. Tomáš Reška.

1. Scope of Application

These Terms and Conditions apply exclusively to all agency agreements between BB and the Patient. Deviating terms of the Patient shall not be recognised unless BB expressly agrees to them in writing.

2. Conclusion of Agreement and Process

The agreement is concluded when the Patient submits the signed Surgery Application (including acceptance of the Terms and Conditions) to BB. BB reserves the requested surgery date for the Patient for three working days. Within this period, the Patient must provide a binding confirmation of the date and make the agreed down payment.

Prior to the procedure, the Patient must undergo the following medical examinations (no older than two weeks before the surgery date):

  • Blood count (complete blood count)
  • Urinalysis
  • ECG (from age 40)
  • Chest X-ray (from age 40)
  • Blood coagulation values (Quick/INR, PTT)
  • Blood sugar (HbA1c for diabetic patients)
  • Blood type

The results must be submitted to BB and the clinic no later than one week before the procedure.

3. Prices and Payment Terms

The following fees apply:

  • One-time agency fee: CHF 200
  • Travel organisation fee: CHF 40
  • Surgery down payment (varies depending on the procedure)

All prices are exclusive of 8.1% Swiss value-added tax, where legally applicable. The remaining balance for the procedure is paid directly at the clinic in Prague before the surgery. Payment arrangements are agreed individually.

4. Cancellation and Cancellation Fees

In the event of cancellation of the surgery date by the Patient, the following cancellation fees apply:

  • 91 or more calendar days before the surgery date: 30% of the down payment made
  • 61–90 calendar days before the surgery date: 50% of the down payment made
  • 0–60 calendar days before the surgery date: 100% of the down payment made

For date changes requested by the Patient, a processing fee of CHF 100 shall be charged, provided the change is communicated at least 30 days before the original date.

If a procedure is not possible for medical reasons beyond the Patient’s control (documented by a medical certificate), no cancellation fees shall be charged. BB reserves the right to offer alternative dates in the event of changes on the part of the clinic or the physician (e.g. illness of the surgeon).

5. Liability

BB acts exclusively as an intermediary between the Patient and the Czech specialist clinics and physicians. BB’s liability is limited to the services arising from the agency agreement.

Liability for medical services, treatment outcomes, complications or any other consequences of the medical procedure rests solely with the performing clinic or the treating physician under Czech law. BB assumes no liability for travel, accommodation or any other ancillary services.

6. Data Protection

The Patient consents to the transfer of their personal data (including health data) to the referred Czech clinic and the treating physician for the purpose of appointment preparation, treatment and aftercare. BB is entitled to obtain information regarding the course of treatment from the Patient or the clinic after the procedure in order to ensure the quality of the agency service.

Data is processed in accordance with BB’s privacy policy and the applicable data protection legislation (Swiss DPA, GDPR).

7. Amendments to the Agreement

BB reserves the right to modify its services, prices and these Terms and Conditions at any time. Changes shall be communicated to the Patient in a timely manner. In the case of ongoing agreements, material changes require the Patient’s consent.

8. Applicable Law and Jurisdiction

These Terms and Conditions and all legal relationships arising therefrom are governed exclusively by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Zurich, Switzerland.

9. Severability Clause

Should individual provisions of these Terms and Conditions be or become wholly or partially invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by an effective provision that comes as close as possible to the economic purpose of the invalid provision.
